Workers Comp Law | Updates 

Kite has provided workers comp applicants a potential increase in recovery for multiple injuries. In Kite, the applicant suffered CT injuries to both hips, and had surgery.  His use of a cane afterwards resulted in injuries to his shoulder and wrist.  The effect of injuries to both hips caused more disability to the applicant than if he had had a single hip replacement.

The PQME determined the best way to combine the impairments was to add, rather than to use the The Workers Comp Law Combined Values Chart (which deducts for overlap of injuries).  The Court allowed the use of the addition, and reconsideration was denied.
